MARK & MEADOWS – SHANTINIKETAN

These Terms of Stay (“Terms” or “House Rules”) govern reservations, accommodation and use of facilities at Mark & Meadows – Shantiniketan (“the Resort”).
By making a reservation, entering the Resort premises or using any facilities or services of the Resort, guests acknowledge and agree to comply with these Terms.
The Resort reserves the right to amend these Terms from time to time in accordance with operational requirements, applicable laws or safety considerations.

1. RESERVATIONS AND CONFIRMATION
1.1 Reservations are subject to availability and confirmation by the Resort.
1.2 A reservation shall be deemed confirmed only upon receipt of the prescribed advance payment or confirmation through an approved booking channel.
1.3 The Resort reserves the right to release any reservation if payment is not received within the stipulated time.
1.4 Confirmed reservations apply only to the dates and number of occupants specified in the confirmation. Actual room allotment would be done at the time of check-in based on room availability. However, the Resort would endeavour to allot rooms with minimum occupancy configuration matching the declared number of adults at the time of booking.
1.5 Any modification in occupancy, room category or duration of stay may result in revised tariffs.
2. CHECK-IN AND CHECK-OUT
Standard Check-In Time: 1:00 PM | Standard Check-Out Time: 11:00 AM
2.1 Early check-in and late check-out are subject to availability and may attract additional charges.
2.2 Guests arriving before the standard check-in time may be accommodated depending on room availability.
2.3 Rooms occupied beyond the permitted check-out time without prior approval may attract additional charges equivalent to partial or full room tariff.
2.4 Check-in for unaccompanied minors are not allowed.
2.5 Early morning or late-night check-out would require prior intimation to the Reception desk and prior clearance of the pending bill amount (if any).
3. IDENTIFICATION AND REGISTRATION
3.1 All guests (including minors) must provide valid government-issued photo identification at the time of check-in.
3.2 Acceptable identification documents include: Passport, Aadhaar Card, Driving License, Voter Identification Card.
3.3 Foreign nationals must present a valid passport and visa in accordance with Indian government regulations.
3.4 The Resort maintains guest registration records in compliance with applicable legal requirements.
4. ROOM OCCUPANCY POLICY
4.1 Each room category has a maximum occupancy limit determined by safety requirements and operational standards.
4.2 Additional guests may be accommodated subject to availability and payment of applicable charges.
4.3 The Resort reserves the right to refuse accommodation exceeding the permitted occupancy limits.
5. CHILD POLICY
5.1 Children upto 5 years may stay complimentary when sharing existing bed with parents.
5.2 Children aged 6–11 years may be accommodated with additional charges. We encourage declaration of the accompanying child/ children during booking.
5.3 Guests aged 12 years and above are equated as adults for accommodation and tariff purposes.
5.4 Please choose appropriate room category from selection of double, triple and quadruple bed configurations. There is limited availability of extra mattress.
5.5 Maximum occupancy per room, including children, is subject to the room category guidelines.
5.6 Valid identity and age proof may be requested at the time of check-in.
5.7 Children should be accompanied by parent or guardian at all times and more specifically when wandering around outdoors or near the waterbody.
5.8 Parents or guardians are responsible for the supervision and safety of children at all times. Parents and guardians are responsible for the safety, conduct, and supervision of children throughout the stay.
5.9 Child policy is subject to change without prior notice; prevailing policy at the time of stay shall apply.
6. VISITOR POLICY
6.1 Visitors must report to the Reception upon arrival. These rules, wherever applicable, would also apply to the visitor(s).
6.2 Visitors may be permitted in guest rooms until 8:00 PM subject to Resort approval. Overnight visitors must complete registration formalities and pay applicable charges.
6.3 The Resort reserves the right to restrict visitor access in the interest of safety, privacy or operational considerations.
7. RESTAURANT AND DINING SERVICES
Dining services are available at the Resort’s restaurant.
Indicative dining hours:
Breakfast: 7:30 AM – 10:00 AM | Lunch: 12:30 PM – 3:00 PM | Evening Hi-Tea: 5:00 PM – 6:30 PM | Dinner: 7:30 PM – 10:30 PM
7.1 Timings may vary seasonally or during special events.
7.2 Last orders may be accepted up to 30 minutes prior to closing.
7.3 Outside food and beverages are generally not permitted except for infant food or medically necessary dietary items.
8. ROOM SERVICE
8.1 Room service may be available during designated hours.
8.2 Menu items/ availability and service hours may vary depending on operational requirements.
9. SWIMMING POOL POLICY
Pool Timing: 9:00 AM – 7:00 PM
9.1 Appropriate swimwear or bathing suit is mandatory. Specifically, sleepwear, pyjama, nightgown, innerwear, cargo/ bermuda/ denim shorts etc. are not permitted inside the swimming pool.
9.2 Guests must shower before entering the pool.
9.3 Children must be supervised by adults at all times. It is appropriate for the children to remain within the kids-pool, splash-pad or rain-tower area.
9.4 Running, diving and rough play are prohibited.
9.5 Glassware and food are not permitted in the pool area.
9.6 Guests with medical conditions should consult a physician before using the pool or jacuzzi.
9.7 Guests are requested to remain mindful that the pool has a maximum depth of nearly 5½ feet at the deep end.
9.8 Pool area may generally remain unsupervised. The Resort does not provide lifeguard supervision at all times. Guests use the pool at their own risk.
10. CHILDREN’S WATER FEATURES
10.1 Children using splash pad, rain-tower or water play features must remain under parental supervision.
10.2 The pool deck, water features area may remain slippery. Guardians are requested to restrict their wards from running, chasing or unsafe play.
10.3 In order to conserve water, the water features are operational only for limited time.
10.4 The Resort shall not be liable for injuries arising from any such activity.
11. GYM AND HEALTH CLUB
Gym Timing: 7:00 AM – 8:00 PM
11.1 Appropriate athletic attire and footwear are required.
11.2 Persons under 16 years are not permitted unless accompanied by an adult.
11.3 Equipment must be used responsibly.
11.4 Gym generally remains unsupervised. Guests use gym facilities at their own risk.
12. RESORT GROUNDS AND NATURAL FEATURES
The Resort includes landscaped grounds, gardens, and a natural waterbody.
12.1 Swimming in the natural waterbody is strictly prohibited.
12.2 The depth of the natural waterbody varies and is quite deep at certain sections. Guests are instructed not to venture into or lean into the waterbody.
12.3 Guests are requested not to litter the premises, throw any article, pebbles etc. into the waterbody/ the resort premises (except in the dustbins).
12.4 Fishing may be permitted only in designated areas with prior approval.
12.5 Guests are requested not to enter inside the cordoned off farm area (or kitchen garden).
12.6 Guests are requested for using of the common facilities judiciously so that other guests can also enjoy these facilities. Individual facilities may have specific continuous usage policy.
12.7 Guests must respect the natural environment and avoid damaging plants or landscaping.
13. QUIET HOURS AND GUEST CONDUCT
Quiet Hours: 11:00 PM – 7:00 AM
13.1 Guests are expected to maintain reasonable noise levels to preserve the tranquil atmosphere of the Resort.
13.2 Guests are requested to maintain decorum at all time. No immoral or illegal activity is permitted.
13.3 Disruptive behaviour or noncompliance with the guest rules/ terms of stay may result in warnings or termination of stay.
14. EVENTS AND BANQUET ACTIVITIES
14.1 The Resort hosts weddings, social gatherings and corporate events.
14.2 Guests acknowledge that events may take place in designated venues.
14.3 The Resort will take reasonable measures to minimize disturbance to residential guests.
15. DAMAGE TO PROPERTY
15.1 Guests are responsible for any damage caused to Resort property during their stay.
15.2 The Resort reserves the right to charge guests for repair or replacement costs.
16. LOSS OF PERSONAL BELONGINGS
16.1 Guests are responsible for safeguarding their personal belongings.
16.2 The Resort shall not be liable for loss or damage to personal property unless caused by proven negligence of the Resort.
17. PARKING
17.1 Parking facilities are provided subject to availability.
17.2 Vehicles are parked at the owner's risk.
17.3 The Resort shall not be responsible for theft or damage to vehicles or belongings inside vehicles.
18. SMOKING POLICY
18.1 Smoking is permitted only in designated areas.
18.2 Smoking is not permitted inside the guest rooms. Unauthorized smoking within guest rooms may attract additional cleaning or restoration charges.
19. PET POLICY
19.1 Pets are not allowed within the resort premises.
20. PHOTOGRAPHY AND DRONE POLICY
20.1 Photography for personal use is permitted. Guests are requested to respect privacy of other guests while taking photographs.
20.2 Commercial photography, professional shoots or drone usage require prior written permission from the Resort.
20.3 Unauthorized drone operation is strictly prohibited.
21. PRIVACY OF EVENTS
21.1 Guests must respect the privacy of weddings, corporate events and private functions hosted at the Resort.
21.2 Participation, photography or interference without invitation is not permitted.
22. CCTV SURVEILLANCE
22.1 For safety and security, most public areas of the Resort may be monitored by CCTV surveillance systems.
22.2 Guests entering the premises consent to such monitoring.
23. HEALTH AND SAFETY DECLARATION
23.1 Guests agree to comply with all health and safety guidelines issued by the Resort.
23.2 The Resort reserves the right to deny services to guests who may pose health or safety risks to others.
24. GOVERNMENT REGULATORY COMPLIANCE
24.1 Guests must comply with all applicable laws and regulations of the Government of India and local authorities. Guests are also required to adhere to the applicable conditions stipulated in regulatory compliances.
24.2 The Resort reserves the right to cooperate with law enforcement authorities as required.
25. PROHIBITED ACTIVITIES
25.1 The following are strictly prohibited within the Resort premises: Possession or use of illegal substances; Storage of hazardous materials; Fireworks without authorization; Activities endangering safety or indulging in immoral activities or causing disturbance to other guests.
25.2 Guests are strictly prohibited from alcohol consumption in the open / common spaces within the Resort premises.
26. CANCELLATION AND EARLY DEPARTURE POLICY
26.1 Cancellation policies vary depending on the rate plan or package selected.
26.2 Applicable cancellation terms will be communicated at the time of booking.
26.3 In the absence of any written cancellation clause in booking, the applicable standard cancellation policy of forfeiture of the entire booking amount as cancellation charges would prevail. All bookings are non-refundable unless otherwise mentioned.
26.4 Failure to arrive without prior cancellation may be treated as a No-Show and would attract retention of charges of full amount of stay as per booking.
26.5 Guests departing earlier than the confirmed reservation would be charged retention fees as per booking terms.
27. LIMITATION OF LIABILITY
27.1 To the extent permitted by law, the Resort’s liability for any loss, injury or damage suffered by guests shall be limited to circumstances arising directly from proven negligence of the Resort. The monetary liability of the resort at all circumstances would not exceed the booking amount.
27.2 The Resort shall not be liable for indirect, incidental or consequential damages.
28. INDEMNITY
28.1 Guests agree to indemnify and hold harmless the Resort, its management, employees and representatives from any claims, damages, liabilities or expenses arising from violation of Resort policies, negligence or misconduct by the guest, or damage caused to Resort or other guests.
29. FORCE MAJEURE
29.1 The Resort shall not be liable for failure to provide services due to circumstances beyond its reasonable control including but not limited to natural disasters, government restrictions, unanticipated events, infrastructure disruptions or acts of God.
30. RIGHT OF ADMISSION
30.1 The Resort reserves the right to refuse accommodation or discontinue a guest’s stay if the guest violates Resort policies, engages in unlawful/ immoral/ illegal activity, or causes disturbance to others.
30.2 The Resort also reserves the right to refuse entry in case of guests who have past record of such incidence or when the Resort anticipates any such violation. The decision of the Resort would be considered final in this regard.
31. GOVERNING LAW AND JURISDICTION
31.1 These Terms shall be governed by the laws of India.
31.2 Any disputes shall be subject to the jurisdiction of courts located in Kolkata, West Bengal.
